ARTICLE I. IN GENERAL.

ARTICLE II. FIRE DEPARTMENT*

Sec. 10-16. created; commanding officer.

There is hereby created a department of the city government to be known as the fire department, the commanding officer of which shall be the fire chief.

Sec. 10-17. Composition; chain of command.

The fire department shall consist of the fire chief, the assistant fire chief, the fire marshal and as many captains, lieutenants and volunteers as are deemed necessary. The chain of command of the department shall consist of those officers listed in this section in the descending order indicated above.

Sec. 10-18. Power and duties of fire chief.

(a) The fire chief shall exercise a constant supervision over the fire department, taking care that each member of the department is properly trained and drilled in the manner of discharging the duties that may be assigned to him.

(b) The fire chief shall have general charge and custody of all fire stations and of all property of the city in the possession of the fire department, and shall take care that all such property is always kept in good condition and repair and ready for immediate use. All such equipment shall at all times remain the property of the city.

(c) The fore chief shall attend all fires in the city as far as practicable and all orders given by him to the fire department, or any member thereof shall be promptly obeyed by the department, or member. It shall be the duty of the chief of police and every police man of the city to aid him in carrying into effect the provisions of this subsection.

(d) The fire chief shall at all fires have the same police, and may command such assistance from the inhabitants of the city as may be required for the suppression and extinguishment of fires.

(e) The fire chief shall make such rules and regulations for the government of the fire department and of all fires and for the safekeeping and protection of the property under its control, as in his judgment shall seem right and for the best interests of the city and as may be approved by the city manager. Such rules and regulations may be amended, altered or repealed by the city council.

(f) The fire chief shall summarily decide all questions, disputes or controversies arising in the fire department among either officers or men, when the department is on duty.

Sec. 10-19. Fire lines.

The fire chief is hereby authorized, at his discretion, to order the establishment of fire lines and to prohibit anyone from going within such lines. It shall be the duty of all person, except members of the fire and police departments and other persons authorized by the fire chief, to remain on the outside of such fire lines.

Sec. 10-20. Contracts for fire service.

(a) Authorized. The city manager is hereby authorized and empowered to contract with other cities or other governmental authorities to create a pool of fire fighting equipment and personnel from the fire department of this city and other contracting cities or governmental authorities and to set up a plan of mutual assistance in case of major conflagration or major disaster occurring in any of the respective contracting authorities, all in accordance with the provisions of Section 16, Article VI, of the state constitution and of RSMo 71.370 to 71.510. All such contracts shall only become effective upon the passage of an ordinance authorizing the execution thereof.

(b) Determination of contract provisions. The terms and provisions of said contract shall be determined by the city manager and the fire chief and the city manager is hereby directed and empowered to carry out the provisions of such contact on behalf of the city in accordance with the terms thereof.

ARTICLE III. FIRE PREVENTION CODE

Sec. 10-36. Adoption of International Fire Prevention Code.

That a certain document , three (3) copies of which are on file in the office of the City Clerk of the City of Warrensburg, being marked and designated as the International Fire Code/2000, including appendix chapters B, C, D, E, F, and G, as published by the International Code Council, be and is hereby adopted as the Fire Prevention Code of the City of Warrensburg, in the State of Missouri; for the control of buildings, structures and premises as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said international Fire Code/2000, are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in section 10-37 of this article.

Sec. 10-37. Additions, insertions and changes.

The code adopted by section 10-36 is hereby amended by substituting the following sections or portions of sections for those sections or portions of sections with corresponding number of the International Fire Code/2000, or where there is no corresponding section in the code the following sections shall be enacted as additions to the code.

(a) Section 101.1 Insert “City of Warrensburg”.

(b) Section 102.7. Delete in its entirety. Add new sections:

Section 102.7, as follows: Subjects not regulated by this code. Where no applicable standards or requirements are set forth in this code, or are contained within other laws, codes, regulations, ordinances or bylaws adopted by the City of Warrensburg, compliance with the intent of this code shall be determined by the code official for the necessary protection of the health, safety and welfare of the residents of the City Warrensburg. Nothing contained herein shall be deemed to adopt any standard promulgated by any association or board that has contributed to drafting of this code, unless such standard has been specifically set forth herein. No standard of the National Fire Protection Association is adopted by the City of Warrensburg by implication.

(c) Section 103.1 General. Change the first sentence which shall read: “The department of fire prevention is established within the jurisdiction under the direction of the fire chief or his designee.”

(d) Sections 103.2 and 103.3. delete in their entirety.

(e) Section 105.1.4

Section 105.14. Fee schedule. The fees for permits referred to in Section 105.1.2 item 1, Operational permits, shall be as prescribed by resolution of the city council from time to time. (Fees will be for selected items in Sections 105.6.1 through 105.6.46.

The fees for permits referred to in Section 105.12 item 2, Construction permits, shall be as indicated in Section 108.2.1 of the International Building Code.

(f) Section 108 Board of appeals. Delete in its entirety and insert new section to read: “This board shall be as designated in the International Building Code/2000, appendix B.

(g) Section 109.3 Violation penalties. Delete in its entirety. Refer to Section 113.4 of the International Building Code/2000.

(h) Section 110.1.1 Unsafe conditions. Add new last sentence which states: “Article VI of chapter 6 of the Warrensburg Code of Ordinances shall apply.”

(i) Section 111.4 Insert “Fifty ($50.00)”, “Five hundred ($500.00)”.

(j) Section 307.2.2 prohibited open burning. Add new items number 1 and number 2:

(1)Rubbish/waste consisting of combustible materials including, but not limited to, paper, cartons,
rags and like substances is prohibited. Burning of materials that produce heavy dark acrid smoke
such as plastics, foam, styrofoam and similar petroleum based materials is prohibited.

(2)Open burning of hazardous and toxic waste is prohibited.

(k) Section 307.3. Delete in its entirety Exception #2.

(l) Section 311.1.1 Abandoned premises. Delete the last two lines. Replace with “with article VI of chapter 6
of the Warrensburg Code of Ordinances.”

(m) Section 505.1.1. Add new:

Section 505.1.1 Address number size shall be increased by a minimum of two (2) inches for each fifty (50) feet the building is set back from the street, highway or road.

(n) Section 505.1.2. Add new:

Section 505.1.2. If the building is not visible from the street, highway or road, the address shall be posted at the intersection of the driveway and the main road by separate signage. If separate signage is used, numbers shall be installed so there is not less than three (3) feet nor more than five (5) feet from ground level to the numbers.

(o) Section 505.1.3 Add new:

Section 505.1.3. If the property has a rear access drive or road, the address shall be posted on the rear of the building or at the roadway.

(p) Section 506.1 Add new last sentence: “To insure compatibility with our present key box system, the
manufacturer shall be the ‘KNOX COMPANY’.”

(q) Section 907.2.10.4 Add two (2) new sentences at the end which state: “batteries in battery operated
smoke detectors shall be replaced at least once every twelve (12) months. Replacements shall be dated,
in a permanent fashion, when installed.”

(r) Section 907.15.1. Add new:

Section 907.15.1. Fire alarms that are not monitored by a central station shall have each pull station,
exterior horn/strobe and water motor gong signed as follows: “Local Alarm Only, Call 9-1-1.”

(s) Section 3301.1.3, Exception 4. Add new last sentence: “These activates shall not take place within two
hundred (200) feet of combustibles, such as gasoline storage tanks or service station fuel dispensing
pumps. “

(t) Section 3801.2 Permits. Delete in its entirety, add new.

Section 3801.2 Permit required. A permit shall be obtained from the fire chief for each installation of liquefied petroleum gas utilizing storage containers in excess of one hundred twenty (120) gallons individual water capacity; when installations of storage quantities exceed one thousand (1,000) gallons, the installer shall submit plans, and a copy of the state-approved plans, if applicable, to the fire chief; if compliance with the requirements of this Code is shown by submitted plans, a permit may be issued. Installations with an aggregate water capacity in excess of two thousand (2,000) gallons will not be allowed, unless approved by the fire chief, the planning and zoning commission and with final approval of the city council.

(u) Chapter 45 REFERENCED STANDARDS. Replace standard: Page 350 of the 2000 International Fire
Code, Standard reference number EC-2000, “Electrical Code.” All referenced code section numbers in
this standard shall be replaced with the title: “1999 National Electrical Code”.
