ARTICLE I. IN GENERAL

Sec. 6.5 – 1. Adoption of Cable Television Consumer Protection and Competition Act of 1992 Rate Regulation.

(a) The city adopts the Federal Communication Commission’s Cable Television Consumer Protection and Competition Act of 1992 Rate Regulation in its entirety as attached to Ordinance No. 2886 and incorporated herein as if fully set out.

(b) The city shall follow the regulations established by the FCC when regulating basic cable television and equipment rates.

Sec. 6.5-2. Adoption of cable communications regulatory code.

The cable communications regulatory code attached to Ordinance No. 3102 as Exhibit 1, as amended, is hereby adopted and incorporated herein as if fully set out.

ARTICLE II. RESERVED

Editor’s note – Section 2 of Ord. No. 3102, adopted Nov. 27, 1995, repealed Ord. No. 2875, from which this article derived. Formerly, Art. II consisted of §§ 6.5-21 – 6.5 – 31, which pertained to customer service and derived from §§ 1-11 of Ord. No. 2875, adopted Sep. 13, 1993.

ARTICLE III. CITIZENS CABLE REGULATORY ADVISORY BOARD*

Sec. 6.5 – 51. Established.

The citizens cable regulatory advisory board is hereby established to advise the city council on the regulation of basic cable television and equipment rates, and to advise the city manager regarding the resolution of disputes between the cable operator and its subscribers.

Sec. 6.5-52. Members; terms.

(a) The membership of the citizens cable advisory board shall be seven (7) citizens. When practicable, at least one (1) of the appointments should be filled by a certified public accountant, one (1) by a licensed attorney, one (1) by a representative of the Warrensburg R VI School District, one (1) by a representative of Central Missouri State University, one (1) by a local business person, and the remaining two (2) positions by consumers. The members of the board shall be appointed by the mayor and approved by the city council.

(b) The seven (7) members shall serve for a period of three (3) years from the date of their appointment, in staggered fashion. Upon the passage of this section, a board shall be appointed with three (3) members appointed to three-year terms, two (2) members appointed to two-year terms, and two (2) members appointed to serve one-year terms. Thereafter, each new member appointed shall serve three (3) years. All terms shall expire on April 30. Any vacancy in a membership shall be filled for the unexpired term in the same manner as the original appointment.

(c) The mayor, upon the approval of the city council may appoint additional ex officio members of the board for one-year terms.

Sec. 6.5-53. Chairman; vice chairman; meetings.

The citizens cable regulatory advisory board shall choose from among its members annually at its first meeting held after April 30, one (1) of its members to act as chairman and another member to act as vice chairman. The meetings of the board shall be held in the council chambers of the municipal building of the city.
